Iron Trident Disclaimer Of Liability

This Disclaimer (“Disclaimer”) is issued by Iron Trident Concrete Removal Services (“Iron Trident,” “we,” “our,” or “us”) in relation to all demolition, breaking, cutting, and removal of concrete, asphalt, pavement, slabs, walkways, curbing, driveways, pads, or any other hard surface (“Concrete Removal Services”). By hiring or permitting Iron Trident to perform such services, the client (“you” or “your”) acknowledges and agrees to the terms outlined herein.

This Disclaimer is designed to clearly communicate the limitations of our liability and outline areas for which Iron Trident shall not be held responsible, including but not limited to damage to adjacent structures, finishes, surfaces, or utilities—either above or below ground.

1. GENERAL STATEMENT OF LIABILITY

Iron Trident conducts all concrete removal work with a high level of professionalism, using appropriate tools, techniques, and equipment. However, by the nature of the work—particularly when breaking or extracting concrete, asphalt, or similar materials—there is always an inherent risk of incidental damage to nearby surfaces, buried infrastructure, and property finishes.

Iron Trident shall not be held liable for any incidental or consequential damage that may occur during the removal of concrete or hard surfaces, including—but not limited to—damage to:

  • Adjacent concrete or hardscape that is not designated for removal

  • Building exteriors (including brick, stone, stucco, siding, EIFS)

  • Subsurface or buried utility lines

  • Irrigation or sprinkler systems

  • Landscaping or vegetation

  • Driveways, patios, walkways, or curbing adjacent to the work zone

2. POTENTIAL FOR ADJACENT SURFACE DAMAGE

During the removal process, vibrations, impacts, and heavy equipment usage may cause cracking, spalling, or chipping of adjacent concrete or asphalt, even if that surface is not the target of the removal. This is especially true where expansion joints are not clearly defined, where concrete is poured continuously across sections, or where the original pour was done without adequate separation.

Iron Trident does not guarantee the integrity of adjoining surfaces and accepts no responsibility for any cracking, delamination, or surface damage to any concrete or paving adjacent to the removal area.

Where necessary, Iron Trident will take reasonable precautions (e.g., saw cutting, protective barriers, controlled demolition methods), but due to the unpredictable behavior of materials and the original quality of installation, adjacent surface damage may still occur. Such damage shall be considered a normal and accepted risk of concrete removal and will not be covered by Iron Trident

3. DAMAGE TO BUILDING EXTERIORS AND STRUCTURES

Concrete removal often occurs in proximity to homes, buildings, garages, or other structures. Iron Trident is not liable for any damage to building finishes or exterior materials that may occur as a result of vibrations, equipment operation, material removal, or accidental contact during the removal process.

This includes, but is not limited to:

  • Brick, block, or stone masonry

  • Stucco finishes

  • Vinyl, metal, or wood siding

  • EIFS (Exterior Insulation and Finish Systems)

  • Windows, doors, trim, vents, or downspouts

  • Foundations or footings adjacent to concrete pads

Clients are advised to inform Iron Trident of any particularly fragile finishes or areas of concern prior to commencement of work. Iron Trident may attempt to take added precautions if such information is provided in advance, but makes no guarantee against damage to these areas

4. NO RESPONSIBILITY FOR UNDERGROUND UTILITIES

Subsurface utilities such as electrical lines, water pipes, gas lines, drainage, sewer, or data/communication lines may lie beneath concrete or hard surfaces. In many cases, these utilities are not marked, or marked inaccurately, and may be placed closer to the surface than expected.

While Iron Trident may review available utility locates, the company does not verify their accuracy or completeness. Iron Trident shall not be held responsible for any damage to underground utilities beneath the surface being removed, including:

  • Electrical or power conduits

  • Natural gas lines

  • Sewer or drainage pipes

  • Water supply lines

  • Communication, phone, or fiber-optic cables

  • Private utility connections not shown on public locate maps

We encourage all clients to provide as-built plans, maps, or private locate services in advance. Should damage occur, the client will be fully responsible for the cost of repairs, service restoration, and any applicable utility company fees.

5. IRRIGATION SYSTEMS AND PRIVATE LINES

Iron Trident assumes no responsibility for damage to irrigation systems, including sprinkler heads, underground piping, valve boxes, or low-voltage landscape wiring, that may lie beneath or around the concrete being removed.

These systems are rarely marked, and their depth and layout are unpredictable. The client is responsible for:

  • Informing Iron Trident of any known irrigation or water systems in the work area

  • Marking or flagging sprinkler heads or control valves where possible

  • Accepting full liability for repairs should such systems be damaged during removal

6. NO GUARANTEE OF COMPLETE REMOVAL IN TIGHT AREAS

In some cases, complete removal of concrete or other materials may not be feasible due to:

  • Proximity to fragile building structures or finishes

  • Inaccessibility due to limited space or overhangs

  • Buried reinforcements such as rebar or wire mesh near utility lines

  • Risk of causing collateral damage during further removal

In such cases, Iron Trident may leave a portion of material intact, trimmed, or partially removed in order to avoid structural or utility damage. This is done solely for safety and preservation of the surrounding property. The client acknowledges and agrees that such areas may not be removed in full, and that Iron Trident will not be liable for return visits or additional work unless agreed upon in a separate scope.

7. VIBRATION AND STRUCTURAL IMPACTS

Mechanical concrete breaking and slab removal may cause vibrations that transmit through soil and structures. These vibrations can, on occasion, cause:

  • Hairline cracks in building foundations

  • Settling of adjacent pavers or stones

  • Loosening of masonry or tile

  • Disruption of poorly compacted soils

Iron Trident shall not be liable for damages caused by vibrations or unintended impacts due to the mechanical nature of the removal equipment.

8. PROPERTY ACCESS AND PROTECTION

Iron Trident will take reasonable precautions to avoid property damage while accessing the removal area, but shall not be liable for:

  • Ruts in grass, turf, or landscaping from heavy equipment

  • Scratches, chips, or scuffs to driveways or walkways

  • Damage to decorative rock, mulch, or garden features

  • Dust, dirt, or debris caused by removal activities

The client is responsible for protecting or removing any delicate fixtures, decorations, or plants within the immediate work zone.

9. INSURANCE & DAMAGE RESPONSIBILITY

Clients are encouraged to verify their homeowner’s or property insurance coverage for excavation-related damages or utility repairs, as Iron Trident’s insurance policy is designed to cover major incidents caused by negligence—not incidental damage that is considered part of the normal risks of concrete removal.

Should any utility line, irrigation component, or surface structure be damaged during removal, the cost of repair or replacement shall be the responsibility of the client, unless Iron Trident has explicitly agreed otherwise in writing

10. ACKNOWLEDGEMENT OF RISK

By hiring Iron Trident for concrete removal services, you acknowledge that:

  • You have been made aware of the typical risks involved with concrete/asphalt removal

  • You understand that damage may occur to adjacent surfaces, utilities, or finishes

  • You accept financial and logistical responsibility for such damage

  • You release Iron Trident from liability for any incidental or collateral damage resulting from the removal process

11. SEVERABILITY AND GOVERNING LAW

If any portion of this Disclaimer is found to be unenforceable, the remainder shall remain valid and enforceable. This Disclaimer is governed by the laws of the jurisdiction in which the work is performed. Any legal disputes must be brought forth in accordance with local regulations.
